In this afterword I will try to re-launch the inquiry into the causes of good-bad polity and good-bad relationships between man and society, individual and institutions. Through an analogy between Einaudi’s search for good government and Calvino’s “Invisible cities”, I will sketch an account of the human and invisible foundations – first of all: trust/distrust – of any good-bad polity.

The book presents an interdisciplinary exploration aimed at renewing interest in Luigi Einaudi’s search for “good government”, broadly understood as “good society”. Prompted by the Einaudian quest, the essays - exploring philosophy of law, economics, politics and epistemology - develop the issue of good government in several forms, including the relationship between public and private, public governance, the question of freedom and the complexity of the human in contemporary societies.

In this article we introduce the reader to the reasons that led to this collection: an interdisciplinary exploration aimed at renewing interest in Luigi Einaudi’s search for «good government», broadly understood as «good society». Prompted by the Einaudian quest, the essays – exploring philosophy of law, economics, politics and epistemology – develop the issue of good government in several forms, including the relationship between public and private, public governance, the question of freedom and the complexity of the human in contemporary (...) societies. The common thread of these essays is that problematic but indissoluble knot that tells us something deeply human: our being torn between homing and roaming, institutional and individual, law and freedom, real and ideal. Can taxation and the redistribution of wealth through the welfare state be conceived as a modern system of circulation of the gift? But once such a gift is institutionalized, regulated and sanctioned through legal mechanisms, does it not risk being perverted or corrupted, and/or not leaving room for genuinely altruistic motives? What is more: if the market’s utilitarian logic can corrupt or ‘crowd out’ altruistic feelings or motivations, what makes us think that the welfare state cannot also be a source (...) of corruption? To explain the standard answers to the abovementioned questions as well as their implications I will first re-examine two opposing positions assumed here as paradigmatic examples of other similar positions: on the one hand, Titmuss’s work and the never-ending debate about it; on the other, Godbout’s position, in-so-far as it shows how Titmuss’s arguments can easily be turned upside down. I will then introduce and reinterpret Einaudi’s “critical point” theory as a more complex and richer anthropological explanation of the problems and answers considered herein. Through the analysis of these paradigmatic positions I will develop two interrelated arguments. 1) The way these problems are posed as well as the standard answers to them are: a) subject to fallacies: the dichotomy fallacy and the fallacy of composition; b) too reductive and simplistic: we should at least try to clarify what kind of ‘gift’ or ‘corruption’ we are thinking about, and who or what the ‘giver’, the ‘corrupter’, the ‘receiver’ and/or the ‘corrupted’ party are. 2) The answers to these problems cannot be found by merely following a theoretical approach, nor can they be merely based on empirical evidence; instead, they need to take into account the forever troublesome, ambiguous and unpredictable matter of human freedom. The publication of Guido Calabresi’s book “The Future of Law and Economics” has drawn a substantial amount of attention among law and economics scholars. We thought that the best way to devote special attention to this book was to devote a Special issue to it. This article situates Calabresi’s book among other reflections on the future of the discipline, introduces and explains the reasons behind this Special issue and discuss the organization and content of it. -/- We emphasize how Calabresi’s (...) historical-conceptual standpoint allows him to isolate the stakes of different future developments around the question of how could further appreciation of legal institutions that defy the standard economic assumptions help the field develop theoretically. Overall, the contributors all shared Calabresi’s attempt to restore the balance between Law and Economics and the need to better account for the “whole unanalysed experience of human race”, often neglected by the Economic Analysis of Law approach. Most disagreements are about the ‘how’. In any case, the search for the Law and Economics ‘not (yet) taken’ or for other “Law and … ” approaches is always open to the Future. (shrink)

This introduction explains the reasons behind this Special issue and discuss the organization and content of it. The difficulty of a genuine dialogue and understanding between economics, law and humanities, seems to be due not only to the fragmentation of reflections on man, but to a real ‘conflict of anthropologies’. What kind of conceptions of man and human values are presupposed by and / or privileged by economics, law, economic approaches to law and social sciences? How and when do these (...) conceptions come into conflict within and between disciplines? How do these conceptions of man and his values influence the conceptions of economics, law and institutions, and vice versa, how do these last conceptions influence the former? What are the normative, regulatory and practical implications of assuming an anthropological and / or axiological perspective instead of another? This Special issue aims at exploring the possibility of finding a common ground for discussion between economics, law and humanities, through the analysis and comparison of both the conceptions of man, human action and values assumed by economics, law and humanities, and their normative implications. The contributions to this Special issue and its organization are outlined at the end of this introduction. (shrink)

The paper aims to address the following two questions: what kind of discourse is that which attempt to found or defend the autonomy or the boundaries of a discipline? Why do such discourses tend to turn into normative, dogmatic-excommunicating discourses between disciplines, schools or scholars? I will argue that an adequate answer may be found if we conceive disciplines as dogmatics, where such discourses often take the form of a discourse on the foundation of a discipline, a foundation in the (...) name of which the scholar speaks and with which he/she entertains an identity relationship. To this purpose I will re-examine the methodological discourses of (and debates between) Pareto, Croce and Einaudi on the demarcation issue between philosophy, economics and value-judgments as highly instructive to understand such issues. In this essay I intend to analyze the issue of good government in the works of Adam Smith, the importance of which seems to have not received due attention. The reconstruction is driven by three hermeneutical hypotheses concerning the role played by the idea of good government in the development of Smith's speculation: 1) the «good government» has a synthetic character, holding together the different aspects – moral, legal, economic and political – of his reflection; 2) it emerges against the (...) backdrop of the first acquisitions of the Theory of Moral Sentiments about the ‘mediating’ role of the middle class, and especially during the reflection that goes from the Lectures on Jurisprudence to the Wealth of Nations, and then feeds back into the subsequent rewritings of the Theory; 3) From the moment the «good government» appears, it becomes a descriptive and prescriptive idea of the social order. In the conclusions I will show how these hermeneutical hypotheses might have implications in the history of political, legal and economic thought. (shrink)

This paper analyzes Paul of Venice’s theory of measurement of natural properties and changes. The main sections of the paper correspond to Paul’s analysis of the three types of accidental changes, for which the Augustinian philosopher sought to provide rules of measurement. It appears that Paul achieved an original synthesis borrowing from both Parisian and Oxfordian sources. It is also argued that, on top of this theoretical synthesis, Paul managed to elaborate a quite original theory of intensive properties that marks (...) him out not only from the nominalist framework of his Parisian sources but also from the usual realist treatments of the problem. Finally, it is shown that, to a certain extent, Paul undertook to apply the mathematical and logical tools inherited from the Calculatores tradition to empirical problems of natural philosophy, leading to reevaluate his role in the evolution of scientific thought in early 15th-century Italy. I will argue here that Einaudi's thought reveals an awareness that the question of freedom has to do with two inter-related problems: the relation of individuals or communities with their respective limits and the question of going beyond these limits. Limits are to be understood here in the meaning of the foundation or conditions of possibility both of institutions (economic, political and juridical) and of thought and human action.

This article probes the visual spatial représentations underlying the creative conceptual design of complex objects.

A version of the growing block theory of time is developed based on the choice of both consciousness and mathematics as fundamental substances, while dismissing the reality/semantics distinction usually assumed by works on time theory. The well-analyzable growing block structure of mathematical ontology revealed by mathematical logic, is used as a model for a possible deeper working of conscious time. Physical reality is explained as emerging from a combination of both substances, with a proposed specific version of the Consciousness Causes (...) Collapse interpretation. This leads to new solutions to old problems, including the epistemic problem and issues with Relativity. (shrink)

Trotz anhaltender Debatten über Determinismus und Freiheit ist der Sinn von Freiheit weit davon entfernt, ein klar umrissenes philosophisches Problem darzustellen. Betrachtet man Versuche, menschliche Freiheit zu beweisen, und Diskussionen um die soziale Normierung von Freiheit, so ist selten klar, ob hier von einem einheitlichen Phänomen die Rede ist. Aufgrund der Komplexität der Debatten und der historischen Tiefe des Problems lässt sich die Freiheit nicht einer einzelnen Teildisziplin der Philosophie zuordnen. Wer sich auf einen Bestimmungsversuch des Begriffs einlässt, muss zugleich (...) das Verhältnis von Theorie und Praxis klären. This article investigates the relation between the will and evil in Ockham’s thought. The main purpose is to show to what extent the deliberate and conscious will of evil (velle malum sub ratione mali) is possible according to Ockham’s psychological and metaethical assumptions.

Kuhn (1962) proposed an evolutionary model to explain how scientific knowledge is built, based on the concept of paradigm. Even though Kuhn’s model is general, it has been applied to only a few topics in evolutionary biology, almost exclusively to broad-based paradigms. We analyze here, through the lens of Kuhn’s theory, a small-scale paradigm change that occurred with the resolution of the controversy about the mating system of a Mediterranean shrub Phillyrea angustifolia (Oleaceae). We first summarize the different steps of (...) the paradigm change and replace them in the more general context of sex ratio theory. Second, we show how the different steps of the paradigm change can be interpreted by Kuhnian concepts and tools. Finally, we discuss the actual and future status of the new paradigm. (shrink)

book review: Sylvain Lévi, "La dottrina del sacrificio nei Brāhmaṇa. Con tre saggi di Roberto Calasso, Charles Malamoud e Louis Renou", traduzione di Silvia D’Intino. Adelphi, Milano 2009, 224 pp.

Pierre-Sylvain Régis’s Cartesianism is quite singular in seventeenth-century French philosophy. Though, can we speak of a form of experimental science in Régis’s work? After exploring his notions of ‘system’ and ‘hypothesis’, I will define his position in relation to Claude Perrault, Jacques Rohault, and the Royal Society. I argue, first, that the contrasts which traverse French science are not so much about the use of experiments but about whether or not observational data can be traced back to hypotheses and (...) to a coherent system. Secondly, that we can detect a significant similarity between Boyle’s positions and the views expressed by Perrault and also by Régis. Lastly, that French science, even in its Cartesian version, is much more probabilistic than English experimental philosophy. (shrink)

The Système de philosophie by Pierre Sylvain Régis can be considered as the achievement both of the scientific liveliness of the Académie des Sciences in the 17th century and of its fruitful relationship with the Royal Society. Since it aims to shape the new conception of the universe in terms of a system, the Système represents one of the most mature achievements of Cartesian philosophy and it is characterized by an empirical interpretation of Descartes’ thought. The Système therefore reflects (...) two important phenomena occurring in the Europe of the 17th century: the scientific revolution and the proliferation of Academies. In fact, this ambitious work could be undertaken with the support of the Académie des Sciences and the Journal des Sçavants. My paper will analyse the French context by focusing to outline the role which the Académie de France had both in France, as the medium of dissemination of the new philosophy despite censorship, and abroad, in particular through the relationship with the Royal Society in England. I aim to analyse the role of the Journal des Sçavants as a means to share ideas other than by correspondence and as a trait d’union between “rationalist France” and “empiricist England”. I intend to question whether it is possible to establish a connection between the empirical interpretation of French Cartesianism, the consolidation of the Académie de France and the employment of new means of academic communication. The paper will show that the second half of 17th century France represents a remarkable exception to the conventional picture, which states that in 17th century Europe, following the success of a mechanistic interpretation of reality, two philosophical school clashed: rationalism, predominating on the continent, and empiricism, in England. One of the most mature achievements of the Cartesian philosophy is the aim to diffuse Descartes’ thought among a wider audience by presenting his philosophy in an encyclopedic way. A relevant contribution in this field is Pierre Sylvain Régis’s Système. Régis’s contribution consists both in reconciling the new scientific discoveries with les principes de Monsieur Descartes by combining them into a scholarly manual whose aim is to stimulate the ars inveniendi and in recognizing the relevance of Arnauld’s and Nicole’s (...) L’art de penser as manual of Cartesian logic. In an article published on the «Annali della Scuola Normale Superiore di Pisa», pp. 517-55: L’«Art de penser» nella logica del «Système» di Régis) I analysed Régis’s logic in order to point out that, even if L’art de penser represents its only source, La logique of the Système has not to be considered as a mere compendium of the Port-Royal Logique, but as a revision of the latter according to a specific philosophical system, characterized by the empirical interpretation of Descartes’s philosophy. In this paper I provide a synopsis of the comparison between the logic of the Système and the Logique of Port-Royal, in order to resume in a schematic way the results of my research. (shrink)

L’usage de la raison et de la foy ou l’accord de la foy et de la raison (1704) by Pierre-Sylvain Régis can be considered his last attempt to defend the ‘new philosophy’ of René Descartes by vindicating its agreement with faith and protecting it from censorship. This contribution offers an analysis of the theories expounded by Régis in this treatise, showing how these evolved from those of his earlier Système de philosophie (1690), and arguing that both are characterized by (...) a reinterpretation of the Cartesian metaphysics on an empirical basis. In particular, Régis offered an empirical interpretation of the relations between substances, attributes and modes, by which he criticized Spinoza’s metaphysics and attempted to solve the riddle of Descartes’ dualism. This work takes into account three Cartesian manuals diffused in 17th century France ; Jacques Rohault, Traité de physique ; Pierre-Sylvain Régis, Cours entier de philosophie, ou système general selon les principes de M. Descartes contenant la logique, la metaphysique, la physique et la morale ) in order to question if the development of an empirical attitude in the scientific research influenced their approaches to the study of motion. The article intends to deepen the role that these authors give (...) to God in the physical structure of the universe with the purpose of investigating whether their analysis of motion is untainted by the metaphysical component or on what terms it remains linked to it. Unlike many of Descartes’s other followers, Pierre-Sylvain Re´gis resists the temptations of occasionalism. By marrying the ontology of mechanism with the causal structure of concurrentism, Re´gis arrives at a novel view that both acknowledges God’s role in natural events and preserves the causal powers of bodies. I set out Re´gis’s position, focusing on his arguments against occasionalism and his responses to Malebranche’s ‘no necessary connection’ and divine concursus arguments.

Today’s debates present ”occasionalism’ as the position that any satisfying account of divine action must avoid. In this paper I discuss how a leading Cartesian author of the end of the seventeenth century, Pierre-Sylvain Régis, attempted to avoid occasionalism. Régis’s case is illuminating because it stresses both the difficulties connected with the traditional alternatives to occasionalism and also those aspects embedded in the occasionalist position that should be taken into due account. The paper focuses on Régis’s own account of (...) secondary causation in order to show how the challenge of avoiding occasionalism can lead to the development of new accounts of divine action. This volume takes cue from the idea that the thought of no philosopher can be understood without considering it as the result of a constant, lively dialogue with other thinkers, both in its internal evolution as well as in its reception, re-use, and assumption as a starting point in addressing past and present philosophical problems. In doing so, it focuses on a feature that is crucially emerging in the historiography of early modern philosophy and science, namely the complexity in the (...) production of knowledge. The book explores the applicability of this approach to a long-considered armchair philosopher, namely René Descartes, who is now more and more understood as a full-blown scientist, networker, and intellectual éminence grise rather than as the mere philosopher of the cogito, as well as the originator of different ‘Cartesianisms’ which encompassed many ideas and approaches for long captured by dichotomic historiographical categories as rationalism and empiricism, or speculative and experimental philosophy. The essays gathered in the volume aim to address the ways in which Descartes’s philosophy evolved and was progressively understood by scientists, philosophers, and intellectuals from different contexts and eras, either by considering direct interlocutors of Descartes such as Isaac Beeckman and Elisabeth of Bohemia, early modern thinkers who developed upon his ideas and on particular topics as Nicolas Malebranche or Thomas Willis, those who adapted his overall methodology in developing new systems of knowledge as Johannes Clauberg and Pierre-Sylvain Régis, and contemporary thinkers from continental and analytic traditions like Emanuele Severino and Peter Strawson. A reply to “Why ‘Healthy Conspiracy Theories’ Are (Oxy)morons” by Pascal Wagner-Egger, Gérald Bronner, Sylvain Delouvée, Sebastian Dieguez and Nicolas Gauvrit.

After the discoveries of such scholars as J. H. Poincaré, E. N. Lorenz, I. Prigogine, etc. the term ‘chaos’ is used actively by representatives of various scientific fields; however, one important aspect remains uninvestigated: which attitude one should have toward chaotic phenomena. This is a philosophical question and my dissertation aims to find the answer in the history of philosophy, where chaos theme has had its investigators from ancient philosophy to the philosophical theories of the 21st century. My dissertation is (...) based on the idea that sciences and philosophy can achieve significant success in exploring chaos theme when their efforts are combined. This dissertation research is designed to help in the planning of conscious, rational actions towards chaotic phenomena, since it is aimed at exploration and systematic presentation, as well as comprehension of possible systems of such actions – philosophical strategies for interacting with chaos. -/- Results of the dissertation are the following. I reveal, reconstruct, and explain the content of six possible strategies for interacting with chaos that were worked out in history of philosophical thought: ordering, avoiding, transfiguring, preventing, controlling, and integrating. I argue that the first philosophical strategies for interacting with chaos were worked out in the 19th century by German philosophers K. W. F. Schlegel and F. W. Nietzsche on the basis of their rethinking the ideas which were expressed by different thinkers during classical antiquity, the Middle Ages, and the modern period. I show that ideas of strategic views towards chaos were also elaborated by such 20th-century thinkers as H. Rickert, N. Berdyaev, I. Prigogine, H. Haken, G. Deleuze, Q. Meillassoux, and others. I outline the main stages of the evolution of philosophical strategies for interacting with chaos as well as its regularities. The dissertation shows perspectives of further development of each one of the six strategies for interacting with chaos. -/- In contemporary scientific and philosophical research on chaos, my exploration contributes to the new approach to improving the understanding of aims of acts towards chaotic phenomena. I think that knowing a range of different strategic views of chaos help researchers of chaotic phenomena to choose the most appropriate and rational reactions. In the area of history of philosophy, my research contributes detailed data about development and conceptual transformations of the notion of ‘chaos’ through all periods of Western philosophy. -/- The dissertation consists of five chapters: 1) Literature Review, Methodology and Key Research Terms, 2) Ancient and Medieval Philosophical Ideas about Chaos, 3) Genesis of the First Strategies for Interacting with Chaos, 4) Strategies for Interacting with Chaos in the 20th and 21st Centuries, 5) Regularities and Prospects of the Development of Philosophical Strategies for Interacting with Chaos. In the first chapter I analyze more than five hundred books, articles, and other philosophical and scientific sources in which the chaos theme is raised. I also argue the necessity of applying methods such as analysis, the structural method, the hermeneutic method of interpretation, and the comparative method in my dissertation research. Moreover, in this chapter, I define key terms for my dissertation – ‘chaos’ and ‘philosophical strategies for interacting with chaos.’ -/- Then, in the next chapter, I analyze the appearance and development of Ancient and Medieval philosophical ideas about chaotic phenomena and order. Particularly, I explore thoughts of philosophers such as Anaxagoras, Anaximander, Heraclitus, Empedocles, Plato, Aristotle, Augustine of Hippo, Bernard Silvestris, Ramon Llull, etc. In this chapter I also compare the first Western ideas about chaos with similar thoughts from Eastern philosophy, analyzing Indian and Chinese philosophical ideas about disorder. -/- In the third chapter I explore transformations in understanding the meaning of the term ‘chaos’ in philosophy from the 15th to the end of the 19th century. I analyze ideas about chaos and order from thinkers such as M. Ficino, Paracelsus, F. Bacon, P. Bayle, Voltaire, J. G. Herder, I. Kant, F. W. J. Schelling and other philosophers from the Renaissance, the Age of Enlightenment, and the German idealist period, showing that these thinkers’ new approaches to interpreting the notion of ‘chaos’ were the background for K. W. F. Schlegel’s and F. W. Nietzsche’s creations of the first strategies for interacting with chaos in the 19th century. I finish the chapter with detailed analysis of K. W. F. Schlegel’s strategy for transfiguring chaos and F. W. Nietzsche’s strategy for ordering chaos. -/- The development of philosophical strategies for interacting with chaos in the 20th and the beginning of the 21st century is the topic of the fourth chapter. I research new ideas about ordering chaos (H. Rickert) and transfiguring chaos (N. Berdyaev). Also, I reveal thoughts about avoiding chaos (A. Camus), preventing chaos (J. Ortega y Gasset), integrating chaos (G. Deleuze, Q. Meillassoux). Moreover, I analyze a philosophical component of the strategy for chaos control (I. Prigogine, H. Haken). In the final fifth chapter of the dissertation I trace the major features of philosophical strategies for interacting with chaos and find out the main conditions and periods of their development. Then I outline the prospects for the development of the philosophical strategies for interacting with chaos and show the most productive ways of their progress. (shrink)

A reply to Gérald Bronner, Véronique Campion-Vincent, Sylvain Delouvée, Sebastian Dieguez, Nicolas Gauvrit, Anthony Lantian, and Pascal Wagner-Egger's piece, '“They” Respond: Comments on Basham et al.’s “Social Science’s Conspiracy-Theory Panic: Now They Want to Cure Everyone”.

Henri Lelevel’s La philosophie moderne par demandes et réponses is a very interesting as well as pretty neglected attempt to disseminate the new philosophy among a larger audience, including the non specialists. Either the style of presentation or the oversimplification of the topics discussed is clearly intended to reach people interested to a smattering of philosophy. More than the comparisons between the traditional and the new philosophy and the compendia, this work vouches for the great interest toward the new philosophy. (...) In this particular case the model is the philosophy of Malebranche, whose interpretation of Descartes thought is preferred by Lelevel, worried by the excessive twist given toward empiricism in P.-S. Régis rendering of Cartesian philosophical system. Lelevel’s logic is directed to eliminate the confusion between sense data and knowledge, echoing also Malebranche’s notion of éténdue idéale, one of the major contribution to the reconsideration of Descartes’ thought. This paper aims to sketch the mains topics discussed in the four sections of Lelevel’s work, with some cross-references to Malebranche’s writings. (shrink)
